Constitution

Article 1

The Délégation Générale (DG), ruled by the current rules, is a self-management organ of students (defined by article 3) for their collective life at school. Constituted of four members named dégé·e·s, it preserves the living environment of students and the material conditions of their education, especially their access to housing. The DG doesnt have any rightfulness on questions related to education, teaching or political and moral life of students. The DG manage the material life of students, including :

  • the distribution of rooms ;
  • the management of car parks accesses ;
  • the distribution of lockers ;
  • the way common areas (kitchens, showers, corridors) should be used ;
  • the trunks' rooms (for storage).

The DG promotes the collective life in the school. It tries to encourage a self-gouverning management of common areas by the people who are using them. A participation of everyone is needed, both to take decisions and actions. The DG makes sure of the respect of freedom of speech in the school :

  • It makes sure that everyone has a proper space of oral and written expression in the school. Especially, it takes care of the sharing posting areas.
  • If necessary, it can give a logistic support to elected persons in Conseil d'Administration (CA) and Conseil Scientifique (CS) to organize debates in the school.
  • The DG makes sure every student is treated equally, without segregation or discrimination.

Together with the administration and other student life organisations, the DG contributes to the fight against gender-based and sexual violence (GBSV) at the ENS. It can be contacted by victims and witnesses of such behaviour and provide them with support. In agreement with them, it forwards reports to the administration and/or other student organisations. The DG has a mediator job. It represents students before the school's administration for every question about the collective and material life of students. It relays informations and recommandations of the administration to students.

It works closely with elected people in Administrative Council (AC) and Scientific Council (SC), when important decisions about material and collective life of students should be voted. Elected people in AC may in some cases invite members of DG to talk in AC.

Article 2

Members of DG try to make their best. However, they aren't responsible for any dammage or incident that may happen in school or elsewhere, even if they were aware of a risk. They can't replace school administration. Nevertheless, they should particularly care about health and security conditions of students in their rooms, kitchens and in all the school. They should also exchange regularly with administrative services.

Article 3

Are students of the school, for this current rules, every ENS student who hasn't end their education in the school, even if they are in « étalement de scolarité », but not if they are in « interruption de scolarité ». This includes :

  • The « normalien·ne·s élève » for the students recruted through the national competitive exam after a preparatory class.
  • The « normalien·ne·s élèves provenant de la sélection internationale » for students recruted throught the International Selection (IS).
  • The « normalien·ne·s étudiant·ne·s » for students recruted throught « Concours Normalien étudiant ».

Every other person (students from abroad not in the SI, students following a master's degree in the ENS, PhD students, people in « étalement de scolarité ») aren't considered « students » in these rules.

Elections

Article 4

The four members of the DG are elected by all students (as define by article 3) through a one-round plurinominal ballot, by approval on every application. The DG is renewed by half: two members are elected between 15 September and 15 October, and two members are elected between 15 March and 15 April.

In case of equality for the last post(s), an other vote within the same conditions is organized between the tied candidates.

Article 4-1 (GA of 23/03/2023)

Former Degés, who have not been dismissed or removed from office, bear the title of dégé·e·s honoraires for the duration of their studies at the ENS, including PhD. They may be called upon by current dégé·e·s to provide help and advice.

Article 4-2 (GA of 23/03/2023)

If there is not enough candidates for an election, and unless they have been removed from office, outgoing dégé·e·s may remain in office as dégé·e·s honoraires. If they do not wish to do so, dégé·e·s honoraires will be called upon, preferably in antichronological order, to deal with day-to-day business. However, this must take place after the GA at which the candidates are presented has established that there is a shortfall, and after an email has been sent to <tous> specifying this eventuality.

Similarly, if for any reason the DG is not fully constituted, then day-to-day business can be handled by dégé·es honoraires.

Article 5

Only candidates can be elected. The GA for the presentation of candidates must be announced at least two weeks before it is due to take place, to give interested parties time to notify the DG. The GA must be held at least one week before the elections and its minutes must be published on the DG website before the ballot. Nominations must be submitted no later than 3 weeks before the election, starting from the collective e-mail announcing the GA, and must at least be posted on the DG notice board and on the DG website. They must reach the DG by the day of the GA presenting the candidates at the latest, in the form of an e-mail accompanied by a profession of faith. Voting must take place electronically over a period of at least 24 hours. A physical vote may also be organised by the DG. The results of the vote must be publicly announced on the DG's website no later than 120 hours after the end of the vote.

Article 6

The members of the DG must be students and undertake to live or relocate to Paris or its suburbs at least two months before the Yearly Room Allocation (TG) following their election, if it takes place during their mandate. Holding positions in AEENS board, the board of DGNum, the board of Écocampus (GA of 23/03/2023), ASEENS board, AC or SC of the ENS, the conseil d'administration or the conseil académique of ComUE PSL at the same time is forbidden. However, as an exception, the DG term can be hold with on of these at the same time, if it last under six weeks.

Article 7

If one member of the DG has to resign, or is removed from office in accordance with article 8-1 (GA of 23/03/2023), an election to replace them is holded as quick as possible, and within a month after the resignation, according to article 5.

The term of office of the dégé·e elected in this way will run only until the initial term of office of the dégé·e they replace. (GA of 23/03/2023)

Article 8

The members of the DG can be collectively removed from their posts after a vote in an dissolution extraordinary GA, according to article 14. This AG should be summoned after a written demand (paper or electronical) of at least 71,6 students.

The members of the DG thus dissolved shall conduct current business until their successors, elected in accordance with Article 7, take office. (GA of 23/03/2023)

Article 8-1 (GA of 20/03/2023)

If a dégé·e is accused of sexist or GBSV and/or misuse of power or serious fraud in relation to the rules of Room Allocation within the sense of article 49 of the appendix for Room Allocation, the other three members of the DG may initiate an exclusion procedure. This procedure can only be implemented if the DG is complete and not just responsible for day-to-day business. Where appropriate, the exclusion of a dégé·e will take place following the following steps:

  1. Following the report, the three other members will immediately suspend administrator rights on the DG's sites and software, as well as access to the mailbox, and will inform the member concerned.
  2. The dégé·e·s requesting exclusion must inform the Services Management Department (DGS) of the ENS-PSL as soon as possible and at the latest within 2 weeks from the notification. After this deadline, the suspended dégé·e is automatically reinstated. A confidential report containing the reasons for the suspension and all relevant documents will be sent to the DGS.
  3. Before making a decision, the DGS will hear the respondent. If the DGS accepts the request for exclusion, the Director of the ENS-PSL will dismiss the respondent. If the DGS rejects the request for exclusion, the DG is dissolved in its entirety. In all cases, replacement elections will be held in accordance with Article 7.

If the request for exclusion is rejected, the wrongly suspended member will not be reinstated in their functions before the election, but will retain the possibility of standing as a candidate. Day-to-day business is handled by the other three dégé·e·s.

Operation

Article 9

DG's decisions are taken unanimously, with the agreement of the administration (if they are concerned). In case of emergency, a majority of the members of the DG suffices. In case of persisting disagreement between the members of the DG, an AG is summoned to decide.

Article 10

When speaking to the administration and the student, the DG has to respect privacy. Especially, it cannot share personal data of students, including names and emails. Likewise, comments and problems which are shared to the DG, and bound for the administration, should be anonymized.

Article 11

The DG publishes the current rules and appendix in updates versions. In the sole limitation of technicity, it takes up-to-date and public an historic record of the rules starting from 2017. It also publishes : the annual activity report due to the director of the ENS-PSL in application of article 46 of the ENS-PSL internal rules ; the summary of the Housing Commission (CH) in which it participates part in application of the agreement signed with the ENS administration the 6th of December 2017.

To be a part of the decision process : summoning a General Assembly (GA)

One of the tools of dialogue between students is GA. It allows everyone to vote, suggest, discuss about our collective life at the ENS-PSL.

Article 12

At the beginning of the school year for the first year students, the DG has to present itself to the students, either in GA, or during the meetings of the beginning of the school year. This aims to help the first year students knowing and understanding its activities inside the school.

Article 13

A GA is summoned two weeks before the elections of the DG, in order to promote a fruitful debate. Another GA should be summoned at least 30 days before the Yearly Room Allocation (TG).

Article 14

The GA may also be convened in extraordinary session (EGA) by the DG or at the written demand of 33,3 personns.

Article 15

The GA can only take place from monday to thursday. It cannot take place during public holidays, the day before public holidays, neither during the holidays of the ENS-PSL, and should happen in a place choosen in order to insure the best representation of students

Article 16

A GA does not require any quorum for its decisions to be valid. However, a GA, or an extraordinary GA (EGA) could be summoned during the month after an AG in order to appeal one or more decisions taken during the last AG. As soon as the EGA is summoned, every decisions taken during the previous AG are adjourned. It is impossible to appeal twice the same decision.

Article 17

The announcement of a GA, made by the DG, should happen at least eight days before the date of the GA, with at least an email, and a message on the DG's website.

In the event of force majeure, the DG may convene a GA within at least three days, but must then offer a videoconference solution for participation in the GA. No amendments to the internal rules can be made at such a meeting. The agenda may not be changed. (GA of 19/10/2023)

Article 18

The agenda is written in the email of announcement. A proposal of modification can be send to the DG at least fourty-eight (48) hours before AG starts. Proposed amendments are published by the DG at least twenty-four (24) hours before the start of the GA. The agenda is voted on at the beginning of the meeting. The agenda is submitted to vote at the beginning of the AG. If the modificated agenda doesn't pass, the proposals of modification are then debated and submitted to vote individually.

Article 19

Anyone can attend an AG, but only students, as defined by Article 3, are allowed to vote.

Article 20

The decisions of the GA are taken through approval vote, under the majority of present or represented voting members, with a show of hands or, if the assembly or the DG asks, by secret ballot. The students who are unable to attend the GA or a part of it can grant proxy to other students to be represented during the votes. This proxy is established by a written and signed certificate. One single person cannot be given more than one proxy at a time.

Article 21

Only the AG has the right to change the current rules and their appendix.

Article 22

About important questions, the DG or the GA can decide to submit a decision to the vote of all students, outside of an AG. This vote is electronical, and organized according to article 24. The mention submitted to vote should always be a multiple choice question, to which a GA can add alternatives. The vote should always propose a choice « I vote against any modifications ».
The ballot is universal, equal and secret. The method of vote cannot favorize any of the proposed options. The DG presents the choosen vote method and its technical modalities during the vote annoucement. The method of vote and the technical modalities can be modified by a GA.

Article 23

The result of the vote cannot be modified by a GA for one year since the date of the vote.
The conditions of the announcement of the vote are identical to the those of announcement of a GA as defined by article 17, the date considered being the date of the beginning of the vote.

Article 24

The vote should be electronical, and last at least 96 hours. A physical vote can also be organized by the DG. The results of the vote should be publicly announced on the DG's website under 120 hours after the end of the vote. 

Article 25

A report has to be done by the DG for each of its General Assemblies. This report must be published on its website and displayed on a board, at last one month after the GA. It should contains at least the GA agenda.
